Dominic Donato is of counsel to Coffey Modica O’Meara Capwoski’s New York office, where he focuses his practice on all aspects of construction litigation, including high-exposure New York Labor Law, construction defect and related property damage cases, as well as premises, product liability and professional liability matters, and commercial litigation involving securities fraud.

Overview
Dominic has more than eight years of experience in construction litigation defense in New York’s state and federal courts, as well as in Connecticut state courts. Throughout his career, he has successfully represented general contractors, trade subcontractors, architects, engineers and owner-developers. Dominic strives to add value by carefully analyzing cases and identifying every opportunity to extricate clients from litigation at the earliest possible stage. He has successfully argued pre-answer motions to dismiss in complex, multi-party litigation involving high-rise and luxury condominium construction in the city of New York.
Dominic further maximizes value to clients by strategically conducting discovery. His aggressive approach aims to develop a defense-friendly narrative that favorably positions cases for summary judgment and trial. In one recent matter, Dominic’s motion for summary judgment was granted by the New York State Supreme Court, Commercial Division in a protracted, high-exposure suit involving a construction project that caused significant damage to several surrounding properties and, in one instance, building collapse. Dominic also has experience briefing and arguing appeals in both the First and Second Departments of the New York State Supreme Court, Appellate Division.
